1. Introduction
Work Supply – Temporary Work Lda., “Work Supply”, is committed to guaranteeing the confidentiality, protection and security of personal data entrusted to it within the scope of the exercise of its activity, therefore the respective processing is carried out, strictly, in accordance with the General Regulation on the Protection of Data (RGPD) 2016/679 of the European Parliament and the Council of April 27, 2016, whose implementation in the domestic legal order is ensured by Law no. 58/2019, of August 8.
Under these terms, this Data Protection Policy is published with the aim of informing about the process of processing personal data, the purpose of collection and processing, sharing and/or disclosure, transfers or access and the rights of the holders of the respective data personal.
2. Definitions
In light of the provisions of the General Data Protection Regulation (GDPR), the following are considered:
- Personal data-any “information relating to an identified or identifiable natural person (“data subject”); An identifiable natural person is considered to be a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, electronic identifiers or one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person”.
- Sensitive Personal Data –special categories of Personal Data that” reveal racial or ethnic origin, political opinion, religious or philosophical beliefs, trade union membership, as well as the Processing of genetic or biometric data for the purpose of unique identification of a natural person, health data and relative data to the sexual life or sexual orientation of a natural person”.
- Treatment –“an operation, or a set of operations carried out on sets of personal data, by automated or non-automated means, such as collection, registration, organization, structuring, conservation, adaptation, alteration, retrieval, consultation, use, disclosure through transmission , dissemination or making available, alignment or combination, limitation, erasure or destruction”;
- Responsible for Treatment –a “natural person, legal person, public authority, agency or other body which, individually or jointly with others, determines the purposes and means of the processing of personal data”;
- Consent –a free, specific, informed and explicit expression of will, by which the data subject accepts, through a declaration or unequivocal positive act, that personal data concerning him or her will be subject to processing.
3. Responsible for processing personal data
Work Supply – Temporary Work Lda., with headquarters at Praça da República 10 A, 2620 – 162, Póvoa de Santo Adrião, Odivelas, through your Document Management Department, contact: (+351) 916000084 and email: privacy@worksupply.com, is responsible for processing personal data.
Personal data will be processed in strict compliance with the principles of lawfulness, purpose limitation, data minimization, accuracy, conservation limitation, integrity and confidentiality.
4. Basis and purpose of processing personal data
Work Supply will carry out personal data collection and processing operations for the following purposes:
- preparation and execution of the employment contract and all procedures resulting therefrom, including, among others activities, treatments related to the administration and management of the employment contract and the employment relationship, which constitutes a necessary requirement for the execution of the contract and compliance with the legal obligations to which Work Supply is subject, particularly within the scope of labor legislation, social and tax security, as well as other applicable legislation;
- signing of contracts and secondment agreements, which involves recruitment, profile selection and secondment activities of employees, for the purpose of providing services, at the facilities of Work Supply’s customers and partners.
- preparation of surveys, terms of responsibility for the use of company assets and other similar documents.
- defending the vital interests of employees;
- pursuit of Work Supply’s legitimate interests, namely when the processing of personal data is strictly necessary and proportionate to guarantee the security of networks and information and, consequently, does not prevail over the interests or rights, freedoms and guarantees of the data subject.
Any other processing of personal data that Work Supply may carry out for purposes other than those described in this policy, as well as the subsequent processing of personal data for a purpose other than that for which the personal data was collected, or , the existence of automated decisions, including the definition of profiles, will be subject to information and prior consent from the data subject.
4.1 -Sensitive data processing
When special categories of data are concerned, under the terms set out in article 9 of the General Data Protection Regulation (GDPR), their processing will be carried out within the limits of the law and, in unforeseen circumstances, with prior explicit consent of the data subject.
5. Sharing of personal data
Work Supply may communicate and/or transfer personal data to the entities identified below, not excluding other entities not mentioned, but which have legal legitimacy to process the data in question, namely:
- IGFSS – Social Security Financial Management Institute;
- AT – Tax Authority;
- Banking and Insurance Institutions;
- INE – National Statistics Institute;
- ACT – Authority for Working Conditions;
- Entity responsible for carrying out functions relating to Safety, Hygiene and Medicine at work and insurance activities.
- Customers, legal representatives and other entities formally linked to Work Supply, within the scope of human resources recruitment services and provision of workers for temporary use.
- Any other entity to which payroll processing and/or other functions related to human resources management have been assigned, namely within the scope of the Group’s shared services.
The purposes of the communications and/or transfers referred to in the previous paragraph are:
- The calculation and payment of remuneration, additional benefits, other allowances and bonuses;
- The calculation, withholding tax and operations relating to discounts on remuneration, mandatory or optional, resulting from legal provisions;
- Carrying out non-nominative statistical operations related to salary processing within the scope of the processing entity;
- Compliance with the obligations to which Work Supply is subject, namely within the scope of labor, social security and tax legislation.
5.1 Transfer of personal data outside the European Union
Work Supply will retain personal data only and for the period necessary to carry out the purposes for which they are intended and to comply with its legal obligations, taking into account, when defining this period, both best practices and legal obligations to which is subject, in particular, to labor, social security and tax legislation.
7. Rights of data subjects
The data subject may request at any time, in particular, with regard to access to personal data concerning him or her, its rectification or erasure, limitation or opposition to processing, to lodge complaints with the supervisory authority, www.cnpd.pt, as well as the right to portability of the respective data.
The data subject also has the right to withdraw their consent, for the purposes of data processing, at any time, without prejudice to the lawfulness of the processing carried out based on the consent previously given, and subsequent processing of the same, on another lawful basis, namely, due to the contractual relationship or legal obligation to which Work Supply is subject.
